The adjudicator found that elements of the work were unsatisfactory and incomplete. An application was made by the claimant's contractors to enforce an adjudicator's decision in their favour for a certain sum for unfinished work, together with interest accruing from the date of the adjudicator's decision. The application was opposed by the defendants on the grounds that the claimant was seeking to enforce part of the decision and to repudiate the rest, and that it is submitted that the defendants have a legitimate set-off arising out of the adjudicator's decision which extinguishes the claim. "Held": the adjudicator agreed that the sums claimed should be awarded, but did not reach any definitive conclusion as to the full extension of time due to the claimant.
