520 _a[2007] UKHL 17, 25 April 2007. Appeal by S against decision that his beneficial shares in a property purchased with his then partner D could not reasonably be considered to be equal. It had been held that consideration should be given to the greater contribution by D to the purchase of the house, from her savings and the sale of her previous property. She had also contributed more towards the mortgage payments. "Held": Despite living together for many years and having children, D and S had kept their finances rigidly separate. It could not reasonably be assumed that they had intended their beneficial shares in the house to be equal, particularly given D's greater contributions to the purchase and mortgage. The appeal was dismissed.
