The Trespass (Scotland) Act 1865, enacted to keep clans off their ancestral land, is still used regularly. It fails to make clear its definition of private property. The Land Reform (Scotland) Act 2003 provides little protection from prosecution under the 1865 Act. There remains much need for clarification.
