The Secretary of State accepted that the validity of a compulsory purchase order of land belonging to N was to be dependant on obtaining planning permission. The claimants (N) applied for judicial review of the Secretary of State's assertion that he could make this decision at a date of his choosing and without first informing N of his intentions. "Held": The Secretary of State had acted lawfully as he was not required to specify an intended date for his decision. He could not be said to have acted unlawfully in deviating from his draughted policy of doing so. There was no obligation on the Secretary of State to consult with affected parties ahead of his decision. Application refused.
