The case centres on the deferment rate which a tenant pays for an asset which will return to the freeholder at a future time. To compensate for this the price is commonly set at the amount that the value of the property would be when the lease expires. The Lands Tribunal ruled that a deferment rate of 5% should apply to flats irrespective of their location. Explains that this, in tandem with the Arbib case (L131346) represents a decision in favour of leaseholders.
