520 _a[2007] EWHC 2776 (Admin). Building a wall within the curtilage (i.e. in the garden) of a listed building is not general permitted development and requires planning permission. Permission to build a garden wall by the owner of a grade II listed building on a World Heritage Site was successfully challenged. Initially permission was denied, but the owner subsequently obtained a certificate of lawfulness. This decision was challenged in court. Held: granting the certificate was unlawful and the building owner needed planning permission for the wall (case unreported).
