Damages were awarded against solicitors who negligently failed to advise their clients on their lease causing the clients to leave their business premises. Funnell asked his landlord for permission to carry out improvements to make the property more suitable for his business. The landlord agreed subject to amending the lease to oblige the tenant to do the work. This would add value to the property and increase the rent at review. Funnell's solicitor failed to advise him about the effect this would have. Funnell left the works and the property before the rent review. Held: court ordered solicitors to pay compensation as they were negligent and responsible for their client's losses.
