520 _aReports on a case (L142785) considering a residential tenant's application to extend the lease of his flat. This was the first case decided by the House of Lords under the Leasehold Reform, Housing and Urban Development Act 1993. The landlords argued that they intended to reconstruct part of the flat and so the exception in section 47 of the Act applied. The definition of a premises in which the flat is contained was crucial. It was held, in favour of the tenant, that the remainder of the premises should be an objectively realisable physical space.
