The Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE Regulations) oblige employers to inform and consult employee representatives upon a relevant transfer. Examines the test applied to determine whether such a transfer has taken place. The standard TUPE test arises on transfer of an undertaking or business which retains its identity within the UK. Since 2006 a new TUPE test has included service provision changes which cover the transfer of employees to a buying company. Case law.
