The case concerned whether a right to parking spaces which, were not part of an agreed business tenancy but by a letter of assurance, could be part of a renewed tenancy agreement. Held: the court had a discretion to include a personal right in the new lease, it was not appropriate in this case. The original lease made no provision for external parking and the tenant had not established a case to have terms giving parking rights included in the new lease. Appeal dismissed.
