Tribunal asked to determine: whether an acquiring authority was entitled , if it chose, not to serve notice to treat an owner of an interest in land that it was taking the land under its compulsory powers and whether a claimant could make reference to the Lands Tribunal if notice to treat had not been served on him. Also asked to decide whether the Lands Tribunal had jurisdiction to determine the question of entitlement to compensation. Held: Where land was to be acquired under a compulsory purchase order, the acquiring authority had to give notice to treat to every person with an interest in the land, failing which a person with such an interest could apply to the Lands Tribunal under the Compulsory Purchase Act 1965 for determination of their entitlement compensation.
