V tried to have the claim dismissed on the grounds that, under the terms agreed on his leaving the firm, neither party can make a claim against the other. The most important issue was the extent of any release from liability. Held: claim in favour of the claimant (F). The claim can go ahead because the leaving agreement does not cover claims relating to potential failings by V as managing director.
