Appellant (H) sought to appeal his right to access to common lands as a tenant of the Trustees of Stanbroke Abbey, asserting that the respondents had blocked his access to said lands. H maintained that he should have access to the common rights enjoyed by his father, the previous owner of his property. Application granted: the judge rules that the appellant should be allowed to appeal on the basis of whether or not a schedule reserved the rights of trustees to access to common land.
