Appellant (H) sought to appeal his right to access to common lands as a tenant of the Trustees of Stanbroke Abbey, asserting that the respondents had blocked his access to said lands. H maintained that he should have access to the common rights enjoyed by his father, the previous owner of his property. Application granted: the judge rules that the appellant should be allowed to appeal on the basis of whether or not a schedule reserved the rights of trustees to access to common land. Other aspects of H's request to appeal were restricted, with the judge allowing an appeal solely on aspects of the schedule.
