The court had to decide the amount of compensation due to a claimant (L) for land taken under a compulsory purchase order by the acquiring local authority (S). The property was a retail outlet from which L had ceased trading, except for 16 days before the date of possession. L claimed for the loss of goodwill and other disturbance items. At issue was the compensation payable, and whether disturbance compensation was payable, and if so, the amount. Held: L's claim had been substantially overstated. Compensation was thus ordered at the level assessed by the local authority. The claim for goodwill failed because trading had ceased long before the valuation date and re-commencing trading would not create goodwill.
