Various suggestions are made to simplify such disputes, including clear lease terms as regards the subject matter of any covenants; vacant possession and the importance of alternative forms of dispute resolution. The author comments that litigation over dilapidations is a particularly time consuming and unproductive area, and that if all other methods have been exhausted those bringing such cases must be willing to come to court with a well developed case, supported by sufficient arguments and evidence.
