The Court had to decide whether a legally binding lease had been granted in the face of conflicting accounts of negotiations. An airline food manufacturer (B) leased units on an estate owned by a property company (H). Due to local residents objecting to its activities, B moved premises when its lease with H expired in 2006 and took a lease on another factory. H argued that B had made verbal agreements to stay on the property for three years after 2006. Held: judgement for the claimant. The tenant B had made an oral agreement which was a binding commitment to the landlord and was ordered it to take the leases, as well as pay rent arrears.
