The issue in question was whether the introducer was entitled to payment under, or for breach of, the introductory agreement, and whether the introducer is itself liable in damages for fraudulent misrepresentation. The respondents, AACS had an introductory agreement with the appellant, A, relating to the purchase of an office building. The purchase did not complete on time, and when it fell through AACS claimed 1% of the purchase price and £75 000 from A. A in turn claimed for damages from AACS on the basis that they had failed to inform him of the real state of their negotiations regarding the property. Held: Appeal allowed in relation to the claim for payment by AACS, but the previous judge's dismissal of A's claim for damages for misrepresentation was upheld.
