520 _a[2009] EWHC 2384 (Ch), 12 June 2009. The case relates to a delay in renewal of a commercial lease from a landlord in administration. Somerfield (S) was tenant of a shop. At the end of the lease, S started proceedings for its renewal. The Landlord (P), entered into administration, denied the renewal of the lease to increase the value of the property as it intended to redevelop it. S tried in court to have its renewal rights respected under the Landlord and Tenant Act 1954. P justified his refusal by wanting to delay the renewal proceedings to increase the value of the sale. "Held:" The fact that P entered into administration should not prevent S having its lease renewed. S is allowed to continue its proceedings for a new tenancy.
