520 _a[2009] EWCA Civ 1123, 27 October 2009. The case relates to the payment of estate agents commission linked to the sale of a property. Shamas Charania (C) chose Harbour Estates Limited (H) to sell his property in Chelsea Harbour with a fee of 2.5% of the sale price. Among viewers was M. Yazdani (Y) who visited the property four times in spring 2004 without taking matters further at that time. C ended his agreement with H in August 2005. Shortly thereafter, Y contacted C's niece to view the property. He negotiated for a reduced price. The property was eventually sold to him in January 2006 at a lower price than the one it was marketed for by H. H, upon learning of the sale, claimed its commission on the basis that he introduced the buyer to C. The judge agreed. C appealed the case. "Held" : appeal dismissed. H is entitled to a commission payable by C. Y had been interested in the property and just let matters rest to negotiate a lower price.
