CC and AXD were creditors of the sellers, and challenged the sale on the basis that the main purpose of the sale to D was to put assets beyond their reach. It was argued that the sale was a transaction at undervalue. "Held": appeal allowed. Although part of the intention of the sale was to make the property immune from creditors, CC and AXD had not established the requisite undervalue.
