Respondent (H) claimed that she was entitled to succeed to a secure tenancy of a house under Housing Act 1985 Part IV following death of her mother who was joint tenancy with her husband (H's father) who had survived his wife and had left the property several years earlier. Held appeal allowed. The tenancy of the house was passed to Mr Hicken by virtue of the doctrine of survivorship. As he did not reside in the property, the tenancy ceased to be a secure tenancy.
