520 _a"R (on the application of Sainsbury's Supermarkets Ltd) v Wolverhampton City Council" [2010] UKSC 20 challenged the authority given to local planning authorities (LPA)s to acquired land compulsorily for planning purposes as set out in the Town and Country Planning Act 1990 s226 as amended by the Planning and Compulsory Purchase Act 2004 s99 . The appeal concerned the scope of amended s226 of the 1990 Act and the use of acquiring authorities powers. As a result of this landmark decision, LPAs will re-examine regeneration schemes which require compulsory acquisition of third party land.
