Claimant commercial agent (L) sought commission from defendant investment bank (F) for introducing F to a property. A third party (R), a prospective purchaser of F which was failing, entered into negotiations with L as to L's fee. F denied liability on the basis that it had never instructed L and that R had no authority to enter into a contract with L on behalf of F. "Held": F was not liable to pay commission to L - only R could have been liable as he contracted with L on his own behalf.
