520 _a[2011] EWCA Civ 423, 13 April 2011. Concerns work carried out to a house by the defendant (F). F was employed to supervise work to the basement and other areas of the house by the then owner. The claimants (J) subsequently bought the house, and made a claim against F under the Defective Premises Act 1972 due to repeated flooding of the basement, which they claimed was due to defective waterproofing. "Held": the work carried out did not constitute a 'new dwelling' as described in the 1972 act, and the appeal by F was allowed.
