Considers the important commercial issue of whether a party to a conditional agreement can exercise a right to terminate the agreement because the condition has not been satisfied although the same party was responsible for the failure to satisfy the condition. Applicant commercial developer E tried to extricate itself from a contract agreed with defendant A on the basis that a condition was not satisfied. A contended that E should not benefit from non-compliance with its contractual obligation. "Held": Application refused. HC decided that a party should not benefit from its own wrongdoing.
