520 _a[2009] EWCA Civ 28, 25 January 2012. Government appealed against a High Court ruling that said it was unlawful for them to cut the Feed in Tariff Scheme (FiT) a subsidy that is paid to homeowners that sell electricity from their solar installation. Ministers had announced that the subsidy would be halved to 21p on 12 December 2011, 11 days before a consultation on the proposed cuts was due to end. "Held" Appeal dismissed. The Court of Appeal upheld the original ruling that the Department for Energy and Climate Change could not reduce the Feed-in Tariff subsidy paid to households and businesses. Following the High Court ruling, the government allowed the 43p tariff to remain in place until March 3 2012.
