The Supreme Court in R (on the application of Prudential plc) v Special Commissioner of Income Tax [2013] UKSC 1 concluded by a majority of five to two that legal advice privilege should only apply to members of the legal profession and not to other professionals even if they routinely give legal advice. However the Supreme Court also said that this was a policy best left to Parliament to decide so this ruling may not have much of an immediate effect.
