520 _aCA 9 December 1987 Appeal against a decision by J. McCowan on an application for judicial review . The application relates to a housing improvement grant and the appeal raises a short point of construction on Housing Act 1974 s 75(6) in regard to the meaning of the " certified date ". This is defined as "the date certified by the local authority by whom the application was approved as the date on which the dwelling first becomes fit for occupation after the completion of the relevant works to the satisfaction of the local authority". The works is question were physically completed by 30 November 1982, but clearance by the various local authority departments had not been given before 12 May 1983. The local authority submitted that the "certified date" could not be before 12 May 1983. CA held, affirming McGowan`s decision that the correct date was 30 November 1982.
