520 _aQBD 5 November 1988 Action by estate agents (S) for commission against Mr Scott who had held himself out as agent for one company as vendors, but who was in fact acting for another company not named. Scott gave S instructions to put on the market a property known as Neardown Stables and purported to be acting as agent for Neardown Stables Ltd. On successful completion of sale S submitted an account in respect of their commission. The account was not paid and S`s solicitors sent a letter before action. Scott`s solicitors replied that he was the wrong person to sue; the action should have been directed to Neardown Stables Ltd. Scott was not personally liable as he was acting as agent for another company based in Jersey, Monolith Holdings Ltd, the freehold owner of Neardown Stables. QBD found that Scott was holding himself out as an agent for Neardown Stables Ltd. Monolith Holdings had only been referred to once, in the subject heading of a letter, and its status had not been explained.
