520 _aChD 2 December 1987 Action by Mr and Mrs Strover (S), the purchasers of a house, claiming damages for misrepresentation and negligent misstatement against the vendors Mr and Mrs Harrington (H) and damages for negligence against H`s surveyors . H had instructed their estate agents to prepare particulars of sale which amongst other things stated that the house enjoyed mains drainage . S agreed to purchase the house subject to contract. After the solicitors were instructed, H`s agents wrote to S`s solicitors stating that the sale particulars were inaccurate and there was no main drainage. Unfortunately this information was not passed on to S. H however repeated the misrepresentation in a conversation with S`s surveyor and it was confirmed in the survey report that the house enjoyed main drainage. ChD held that S`s surveyors had not been negligent in relying on the vendor`s assertion and stated that, as a professional, the surveyor could only be held liable for negligence if he acted in
