The SoS had appointed an inspector who, although satisfied on the grounds of pollution control, believed public disquiet could not be allayed, so recommended in his report that planning permission be refused. The SoS argued that due to EPA controls there would be no unacceptable environmental impact. Gateshead applied to quash that SoS`s decision, arguing that he had not given adequate reasons why he went against the inspector`s recommendations and was wrong to say that EPA controls were adequate.
