520 _aQBD 20 July 1987. The second respondent, a county council, made a compulsory purchase order on a hotel, owned by one of the applicants. At an inquiry into the cpo, an inspector held a conversation with officers of the council in the absence of the applicants. The owner and two tenants of the property applied for judicial review to quash the cpo on the grounds that it was vitiated by the appearance of bias . The application was allowed on the basis that a reasonable person, observing what happened, could have drawn the conclusion that a procedural unfairness indicative of bias had occurred despite the fact that the conversation had been a casual one as might occur in the normal course of a site inspection.
