An application for modification of a restriction imposed by a land transfer in 1962, forbidding building on the application land, so as to permit the erection of a bungalow and garage in accordance with planning permission. The objector had a tenant farm manager in a bungalow on the land. LT held that money would be adequate compensation for the objector`s loss since only the diminution in the value of the freehold affected him and his interest was also reversionary. The application was granted under Law and Property Act 1925 s84(1) on payment of £2,500 compensation. | ||
