520 _aQBD 18 January 1996. The council (B) had refused to grant listed building consent for alterations to a listed building to accommodate a lift shaft within a roof valley. An appeal by BD was dismissed by the SoS, noting that the special interest of the building would be reduced by the loss of r the original characteristic valley gutter shape of the roof. BD were concerned to establish a claim for compensation for refusal of listed building consent under Planning (Listed Buildings and Conservation Areas) Act 1990 and sought a declaration that works for which consent had been sought did not constitute development within TCPA 1990 s55. Declaration granted. The works did not amount to development within the meaning of the 1990 Act s55(2)(a)(ii).
