520 _aQBD 16 November 1987. The second respondents were a charitable trust of a school occupying the premises. In 1971 planning permission was granted to use the premises as a house and Christian meeting place, subject to a condition excluding use for any other purpose. In 1984 a school was set up run as a Christian establishment however open air activities led to complaints from neighbours. In February 1985 the council issued an enforcement notice requiring cessation of the use of the school. The respondents appealed under Town and Country Planning Act 1971 s88 in March following a public inquiry the enforcement notice was quashed. The council however appealed and this was upheld.
