C took the point that the proceedings were statute barred as a result of the Limitation Act 1980 s9. In April 1999 a judge held that C was precluded by convention estoppel from relying on the limitation point. C appealed. Appeal allowed on the grounds that there was no estoppel preventing C from relying on the limitation defence.
