Hillingdon LBC v ARC Limited - 2000 - Rating and Valuation Reporter 40(9) [2000] RVR 283-292(10) .

CA 16 June 2000. ARC Limited (A) claimed compensation following the compulsory acquisition by the council (C) of land occupied by them. A submitted its original claim in April 1982, but no reference to the LT was made until September 1995. C took the point that the proceedings were statute barred as a result of the Limitation Act 1980 s9. In April 1999 a judge held that C was precluded by convention estoppel from relying on the limitation point. C appealed. Appeal allowed on the grounds that there was no estoppel preventing C from relying on the limitation defence.
