TCC 12 April 2002. The claimant (B) applied for summary judgement to enforce an adjudicator's decision that it was entitled to a substantial extension of time and therefore repayment of certain liquidated and ascertained damages. M argued that the adjudicator had not acted impartially, had not compiled with the principles of natural justice, and had acted in breach of contract and without jurisdiction. "Held": the courts refused to grant summary judgement on the grounds that the adjudicator had failed to give notice of the approach he intended to take.
