LT 7 February 1996. Determination whether the counter notice served by the council in response to a blight notice served by the claimants (E) could be upheld. At issue was whether land was blighted with the Town and Country Planning Act 1990 sch 13 para 2. The house concerned was subject to policy 4 of the Stratford and Canning Town District Plan. "Held" although the property was located in a blighted area, E had not discharged the onus of proof that the site fell within the Town and Country Planning Act 1990 sch 13 para 2. Claim dismissed.
