At issue was whether land was blighted with the Town and Country Planning Act 1990 sch 13 para 2. The house concerned was subject to policy 4 of the Stratford and Canning Town District Plan. "Held" although the property was located in a blighted area, E had not discharged the onus of proof that the site fell within the Town and Country Planning Act 1990 sch 13 para 2. Claim dismissed.
