ORC 7 June 1989. The plaintiff (F) claim ed payments under the fast track contract they had with the defendants (S). S counterclaimed for costs incurred in transferring work to another company as F fell behind schedule. A third party, subcontractors to F, claimed an indemnity against the counterclaim. A settlement was reached between F and S as both parties realised that to continue action was uneconomic.
