HL 7 December 1989. The appellant`s barn within the curtilage of his house was under an enforcement notice for demolition as it was not on agricultural land within article 3 Town and Country Planning General Development Order 1977 Class VI . The appeal that the adjoining plot separated from the house and curtilage by a farm track owned by a third party, was still an agricultural unit, thereby complying with the minimum area required for development, was dismissed.
