QBD 26 February 1991. Appeal by Dibben Construction Ltd (D) under Town and Country Planning Act 1971 s245 alleging an error of law by Inspector in concluding that development would set a precedent . Planning permission for residential development had been refused by Test Valley (T) on the grounds that the proposed development fell outside the development plan . The HC in analysing the structure plan authority denied that there had been any error in interpreting the law. Appeal dismissed.
