Appeal by Dibben Construction Ltd (D) under Town and Country Planning Act 1971 s245 alleging an error of law by Inspector in concluding that development would set a precedent . Planning permission for residential development had been refused by Test Valley (T) on the grounds that the proposed development fell outside the development plan . The HC in analysing the structure plan authority denied that there had been any error in interpreting the law. Appeal dismissed.
