QBD 28 January 1987. An application by the tenant of a flat for judicial review of a decision of a rent assessment committee determining the fair rent under the Rent Act 1977 . The rent officer had determined a rent of £1,068 plus £168 for services. The committee subsequently fixed a rent of £2,000 with the same amount for services. Communications from the tenant to the committee were ambiguous as to whether she wished to withdraw her objection or was stating that she did not wish to attend a hearing. Unknown to the committee the tenant had written indicating an intention to withdraw which never reached the committee. The committee finally decided she did not intend to withdraw and notified her of arrangements for the hearing which proceeded despite the tenant`s absence. Despite landlord`s support for the rent officer`s determination, the committee increased the fair rent to £2,000 stating the flat had been substantially undervalued although they had been unable to inspect it.
