Valuation maladministration

"Halifax Building Society and others v Edell and others" ChD 28 February 1992. It was held that the ombudsman was obliged under Building Societies Ombudsman Scheme clause 14 to investigate complaints of negligent structural surveys and house buyer`s reports carried out by an employee of a building society as part of an application for a further advance on the properties. Such negligence was maladministration under Building Societies Act 1986 Schedule 12 Part III para 1(d).
