East Midlands Rent Assessment Panel 26 February 1992. Appeal by landlords of six dwelling houses in Aspley, Nottingham against determinations by a rent officer under Rent Act 1977 s70. The properties built in the 1930s were in a reasonable state of repair. Improvements were to disregarded under s70 of the 1977 Act. Landlords argued that following the 1988 Housing Act, a real market for rented property had emerged providing a sound basis for `market rents less scarcity` formula to apply. Landlords` valuer offered the opinion that 10% reflected scarcity. Decided that the `market rent less scarcity` principle did not apply in this instance and the rent officer had under-assessed the fair rents. Accordingly, these were increased.
