In Inglewood Investment Co Ltd v Forestry Commission , CA 18 October 1988, it was held that the word " deer " was conspicuous by its absence from the reservation . Had the word deer been in the mind of the draftsman of the 1921 indenture he would have used it. Where legislation referred to game such as the Game Act 1831 deer were not included unless they were expressly mentioned.
