Cites "Balfour Beatty v Chestermount Properties" as example of where a contractor has passed the extended completion date, is causing delay, and is then instructed for a variation which has the effect of delaying completion further. In upholding the arbitrator`s decision in C`s favour, the court ruled that the developer`s architect had the right to grant extensions of time during a period of culpable delay by B, if employing the `net` basis of deductions rather than the `gross`.
