Lloyds Bank plc v Carrick and another - 1997 - Estates Gazette [1997] 11 EG 155-159(5) .

CA 28 February 1996. C held a long lease on a maisonette, which he allowed his sister-in-law (X) to move into on payment of £19,000. The lease remained in C`s name whilst X was responsible for all outgoings on the property. The title was unregistered. I 1986 C charged the property to L to secure a loan without informing them X lived there. In 1991, L sought repayment of the loan and subsequent possession of the property. C claimed he held the property as bare trustee for X. L claimed X`s interest was as an unregistered contract and was therefore void against them. L`s appeal against an earlier decision that there was no registrable interest upheld.
